Terms and Conditions for Small Construction Works

1. Scope of Work: CS4UK and its subcontractors are responsible for performing small construction works in customers' buildings, as specified in the agreed upon project details. The scope of work includes but is not limited to construction, installation of dispensers and washroom articles, and surface coverings as outlined in the project agreement.

2. Unforeseen Irregularities: CS4UK acknowledges that unforeseen irregularities may exist in the customer's building, such as objects attached to walls that need to be removed for surface coverings installation. It is the customer's responsibility to identify and remove such items before the construction work commences. CS4UK may assist with the removal if requested, but it is not liable for any damage caused to the item or the wall during removal or reinstallation.

3. Customer's Responsibility: The customer is responsible for ensuring that the building is in a suitable condition for construction work. This includes identifying and addressing any irregularities, objects, or obstacles that may hinder the progress of the project.

4. Liability and Indemnity: CS4UK and its subcontractors are not liable for any damage caused to objects attached to walls during the construction process. The customer agrees to indemnify, defend, and hold CS4UK and its subcontractors harmless from any claims, damages, costs, and expenses, including legal fees, arising from such damages or any claims related to the removal and reinstallation of objects.

5. Change Orders: If unforeseen irregularities are discovered during the construction process and require additional work or materials, CS4UK will inform the customer promptly. Any additional work or materials required due to these irregularities will be considered a change order and will be subject to additional charges.

6. Completion Time: Any delays caused by unforeseen irregularities or the removal and reinstallation of objects will not be considered a breach of contract. CS4UK will make reasonable efforts to complete the construction work within the agreed upon timeframe, taking into account any necessary adjustments due to these irregularities.

7. Acceptance of Work: Upon completion of the construction work, the customer or their representative shall inspect the work. If the customer does not provide written notice of any defects or issues within seven days after completion, the work shall be deemed accepted.

8. Governing Law: These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales, and any disputes arising under or in connection with these terms and conditions shall be subject to the exclusive jurisdiction of the courts in England and Wales.

By engaging CS4UK and its subcontractors for the construction works, the customer agrees to these terms and conditions and acknowledges and accepts their responsibility as described above.
